Terms and Conditions of Use

SOBRADOS DE STYLE® (hereinafter referred to as SOBRADOS®) is a brand dedicated to the marketing and/or importation, on its own behalf and/or through third parties, of clothing, eyeglasses with or without correction and/or light filters, sunglasses, frames, lenses, cases, covers, and other optical articles. The website www.sobradosdestyle.com (hereinafter referred to as the «Site») is owned by SOBRADOS, and its use is subject to the provisions set forth in this document.

Definitions

In these General Terms and Conditions of Use (hereinafter referred to as the «General Terms»), the following terms shall have the meanings assigned to them below:

«SOBRADOS or SOBRADOS DE STYLE»: It is a brand dedicated to the marketing of clothing, sunglasses, and other optical articles.

«Site»: It is the website owned by SOBRADOS, through which the articles offered by SOBRADOS are advertised, promoted, and sold.

«Client or Clients»: They are natural or legal persons who browse and/or register on the Site and can purchase the goods and products offered by SOBRADOS.

«Store»: It is the section available on the Site created by SOBRADOS for clients to purchase the marketed products.

1. INTRODUCTION

These General Terms establish a contractual relationship between the Clients and SOBRADOS regarding the use of the Site and the acquisition of the goods and products sold in the Store. The General Terms shall govern the rights and obligations of the parties with respect to any product offered on the Site.

Clients undertake to read, understand, and accept all the conditions set forth in this document, as well as related policies and additional pages on the Site, at the time of their registration as users of the site or when required to do so.

These General Terms shall be deemed accepted from the moment the Client registers on the Site, following the registration process described in this document.

These General Terms shall apply for the entire duration in which Clients make use of the Site.

If you do not agree with the General Terms specified in this document, please refrain from using the Site.

2. WHO CAN USE THE SITE

Only individuals who have full legal capacity to exercise their rights may use the Site developed by SOBRADOS® and purchase the goods offered therein.

Persons who do not have such capacity in accordance with the provisions of Article 23 and following and related provisions of the National Civil and Commercial Code may not make purchases on the Site.

The use of the Site by minors or other persons lacking legal capacity to act, and any acts performed by them within it, shall be the responsibility of their parents, guardians, caretakers, or legal representatives, and therefore, such acts shall be deemed to have been carried out by them in the exercise of their legal representation.

It is understood that the Client who accepts these General Terms and purchases the products offered in the Store on behalf of a company, organization, government, or other legal entity affirms and guarantees that they are authorized to do so and have the necessary powers to represent and bind said entity.

3. REGISTRATION AND VERIFICATION

The use of the Site for the purchase of goods through the Store is subject to Client registration, who must provide, at a minimum, the information marked as mandatory in order to finalize and complete the purchasing process for the offered products.

Individuals wishing to register as Clients on the Site to make purchases must provide certain personal information, such as their name, date of birth, email address, and telephone number, among others.

Those who register as Clients undertake to provide true, accurate, up-to-date, and complete information regarding the requested data. Likewise, they undertake to maintain and update their personal data in order to keep it true, accurate, up-to-date, and complete.

Your personal information will be processed and stored on servers or magnetic media implemented or contracted by SOBRADOS, which comply with high standards of physical and technological security and protection.

Furthermore, the personal data provided by Clients will be processed in accordance with the criteria described in the Privacy and Personal Data Protection Policies, which Clients declare to be aware of.

4. PRIVACY AND SECURITY

SOBRADOS periodically implements and updates its security systems and control mechanisms for the collection and storage of the private and/or personal information provided by Clients, in accordance with the criteria and guidelines described in the Privacy and Personal Data Protection Policies.
5. PURCHASING PROCESS

To purchase the products offered on the Site, the Client must follow the purchase steps indicated below and accept the present Terms and the Privacy and Personal Data Protection Policy of SOBRADOS:

Select the desired product and add it to the cart.
By selecting «view cart,» the details of the chosen products (product, quantity, and price) will be displayed.
To finalize the purchase, the Client must confirm the selection of the desired products by clicking on the «Checkout» link.
Subsequently, the Client must provide the requested fiscal and personal information to enable the billing of the requested purchase and the shipping to the address indicated by the Client. The Client must also select the desired payment method.
To confirm the purchase, after verifying the selected product details, billing information, and shipping address, the Client must select «Place Order.»
The purchase will be subject to the availability of the chosen product in stock.
After the purchase is completed, the Client will receive a confirmation message with the details of their order to the email address provided during the purchase or registration process.
Purchases will be sent by courier or messenger services, at the Client’s expense and upon their order. Shipping details will be provided to the Client once the order has been dispatched, allowing the Client to track the shipment. The delivery time will be informed in each case by the company responsible for shipping, but will not exceed 30 (thirty) calendar days from the confirmation of the purchase for shipments within Argentina.
The prices listed on the Site for the acquisition of the products are expressed in Argentine pesos.
The payment of any fees, taxes, duties, or charges that must be paid for purchases made and/or shipped outside of Argentina shall be borne by the Client.
Purchases made by Clients can be paid through debit cards, credit cards, bank transfers, and Mercado Pago.
The financial cost and/or interest for the installment purchase of products shall be established and informed by each banking institution and/or credit card issuer, as applicable. In all cases, the final price and the value of each installment will be informed to the Clients prior to confirming the purchase.
Sunglasses and other optical articles offered by SOBRADOS on the Site can be purchased by Clients in the city of Rosario, province of Santa Fe, at the establishment operating under the trade name «CENTRO ÓPTICO ROSARIO,» located at Mendoza Street No. 1625 in said city.
6. REFUNDS, EXCHANGES, AND RETURNS

If, due to lack of stock or any similar reason, after the confirmation of the purchase, SOBRADOS is unable to deliver the products purchased by the Client, the Client may:

Request the delivery of a product with similar characteristics and price to the originally purchased one.
Request a refund of the amount paid, which must be made within a period not exceeding 10 (ten) business days.
Additionally, Clients who purchase products as final consumers have the right to request the exchange or return of the purchased product on the site within a period of five (05) calendar days from the product delivery.

To cancel the transaction and request the return of the purchased goods and the refund of the money, the Client must request it by accessing the «Withdrawal Button» section available on the website. SOBRADOS may not refuse the cancellation of the transaction when it is requested by the client within the legal timeframe and in compliance with the legal provisions and the provisions contained in these General Terms. Within 24 (twenty-four) hours of receiving the cancellation request from the Client, SOBRADOS will provide the client with a code or identification number for the procedure.

To request an exchange or replacement of the product for a different one, the Client must contact SOBRADOS at the email address provided in the purchase confirmation, within the aforementioned time frame.

SOBRADOS will not accept requests for exchanges or returns that have not been made within a period of five (05) calendar days from the product delivery.

In the event of canceling the purchase or when a refund of the money is due for any reason, the refund method will depend on the chosen method of payment for the purchase to be canceled.

The costs of returning the product will be borne by SOBRADOS when the return is made in compliance with the aforementioned provisions.

In all cases, the product must be returned by the Client unused, in the same condition as received, with its original packaging, and all corresponding accessories, including identification labels.

Returns of damaged or altered products will not be accepted.

7. WARRANTY

All products purchased on the Site come with a warranty period of 6 (six) months.

In all cases where the warranty is claimed, the Client must request it directly from SOBRADOS by sending a communication to the email address provided in the purchase confirmation.

8. INTELLECTUAL PROPERTY

All Clients acknowledge and accept that SOBRADOS is the sole and exclusive owner of all intellectual property rights derived from or related to the Site, including, but not limited to: trademarks, designs, slogans, patents, web domains, copyrights, and software.

The trade name of SOBRADOS, the trademark of SOBRADOS, and the offered products are the exclusive property of SOBRADOS. Unauthorized use will be subject to the consequences established by applicable law. Clients may use the Site only to the extent established in these General Terms and for the purpose expressed in this document.

Clients are prohibited from modifying or attempting to modify any functionality of the site, producing any derivative work, or accessing any part of the site to create a competing product or service or any product or service that contains ideas, features, or functions similar to those of the Site. Likewise, Clients must refrain from using, copying, or transferring any material contained on the platform without the proper written authorization from SOBRADOS.

9. LIMITATION OF LIABILITY – INDEMNITY

SOBRADOS shall not be liable for any type of damage, whether direct or indirect, consequential or incidental, punitive damages, loss of chance or profits, loss of information or data, among others, when such damages are a result of improper use of the Site and/or the products offered by SOBRADOS in the Store, or when they arise from the sole responsibility of the Client or third parties unrelated to SOBRADOS.

Furthermore, Clients agree to defend, indemnify, and hold SOBRADOS harmless against any obligation, damage, loss, and/or expenditure of any kind (including costs and professional fees) arising from the improper and/or incorrect use of the Site and/or the products offered in the SOBRADOS Store and from the damages caused to third parties due to non-compliance with the provisions contained in these Terms and Conditions.
10. MODIFICATION OF TERMS AND CONDITIONS

SOBRADOS reserves the right to modify these General Terms at any time. When this occurs, SOBRADOS will make the introduced modifications public and visible through notices on the Site. In all cases, the modified terms will come into effect 10 (ten) calendar days after their publication.

Clients who disagree with the modifications introduced may choose not to accept them when their agreement is requested upon accessing the site. In this case, they must refrain from continuing to use the Site and/or the SOBRADOS store.

It is noted that, in all cases in which modifications are made to these General Terms and/or the related policies that are applicable, Clients will be duly informed about the nature and scope of the changes introduced through the notices referred to in the preceding sections.

11. DISPUTE RESOLUTION

In the event of any potential or hypothetical disputes that may arise on occasion, due to or as a consequence of the use of the Site and/or the purchase of products marketed by SOBRADOS, Clients agree to submit to the exclusive and non-extendable jurisdiction of the ordinary courts of the city of Rosario, province of Santa Fe, Argentina, waiving any other jurisdiction that may apply.
